Terms and Conditions of Use

CHAPTER 1. GENERAL PROVISIONS

Article 1 (Purpose)
The purpose of these Terms and Conditions is to stipulate the conditions and other necessary matters regarding the use of Seoul Bike introduced and operated by the Seoul Metropolitan Government.

Article 2 (Notice of Terms and Conditions)
➀ When registering as a member to use a Seoul Bike (or when purchasing a new pass after the enforcement date of these Terms and Conditions), the user shall be deemed to have understood and agreed to the contents of this agreement.
➁ Seoul Bike may amend these Terms and Conditions within the scope that does not violate the relevant laws and regulations, and when changing the Terms and Conditions, a notice period of at least seven (7) days shall be given to the customer from the enforcement date. The changed Terms and Conditions shall take effect from the enforcement date announced during the notice period.
➂ If the user does not expressly reject the changed Terms and Conditions during the above notice period, it shall be deemed that the user agrees to the changes of these Terms and Conditions. If the user does not agree to the changed Terms and Conditions, the user may cancel (withdraw) the membership in accordance with Article 12 of the Terms and Conditions.

Article 3 (Rules other than the Terms and Conditions) Matters not defined in these Terms and Conditions shall be followed if there are related laws and regulations; otherwise, the general practice will follow.

Article 4 (Definition of Terms) The terms used in these Terms and Conditions are as follows.
1. User refers to a person who agrees to the Terms and Conditions of Use for Seoul Bike (hereinafter referred to as the “Terms and Conditions”) and has signed up as a member, regular member, or non-daily member of Seoul Bike.
2. Member refers to a person who has signed up as a member of Seoul Bike by agreeing to these Terms and Conditions.
3. Regular member refers to a person who has obtained the right to use a Seoul Bike after agreeing to these Terms and Conditions, signing up for membership to use a Seoul Bike and making a regular payment.
4. Non-member user refers to a user who uses the non-member pass.
5. Password refers to a combination of English letters, numbers and special symbols chosen by an individual and set to protect personal information registered on the Seoul Bike system.

7. Seoul Bike refers to bikes that can be rented by members and non-member users at the Seoul Bike Rental Station.
8. Rental Station refers to an unmanned facility that allows members/users to rent and return bike without assistance.
9. Bike rack refers to a semi-automated bike rack/parking facility at the rental station.
10. Rentals involve first selecting a bike at the Seoul Bike Rental Station when purchasing and registering a ticket, then unlocking the lock according to the specified method, and receiving an audio message saying “unlocked” from the bike terminal.
11. Returns involve first loading the bike at the Seoul Bike Rental Station when locking the lock according to the method specified by the Seoul Metropolitan Office, and receiving audio and text messages (SMS, etc.) reading “returned” from the bike terminal.
12. Smartphone refers to a personal mobile phone that allows users to accept information and use the services they want to receive using the app program.
13. Seoul Bike App refers to an app that allows users to sign up for Seoul Bike membership, pay basic fees, and use services.
14. Service use refers to a series of activities in which the user rents and uses a bike at the Seoul Bike Rental Station and returns it.
15. Basic fee refers to the fee specified when purchasing a commutation ticket or one-day ticket.
16. Basic use hours refer to the designated use hours for each ticket without paying a separate use fee other than the basic fee.
17. Maximum overtime rental time refers to a total of 4 hours for a 1-hour ticket and 6 hours for a 2-hour ticket. If the time limit is exceeded, the bike may be considered lost or stolen.
18. Additional fee refers to the fee specified by Seoul Bike to be paid when the basic use hours are exceeded.
19. Transfer mileage applies exclusively to users who have purchased a commutation ticket keeping track of their accrued mileage when transferring within 30 minutes from a to or from to a (However, transfer mileage is provided only for tickets announced by Seoul Bike).
20. The all-day ticket allows foreign users to rent a bike at the Seoul Bike Rental Station and use it for up to 24 hours without returning it in the middle.
21. A corporate group ticket can be purchased by a corporation and provided by gifting it to members or non-member users.

CHAPTER 2. MEMBERSHIP RULES

Article 5 (Membership Application)
① Any citizen over the age of 13 who can ride a bike may become a member of Seoul Bike.
② Anyone who wants to become a member of Seoul Bike shall sign up for membership on the Seoul Bike website or app.
③ When registering as a member, he/she shall fill in the required information in each of the following subparagraphs.
(However, simple login follows the simple login steps below.)
1. Name
2. Date of birth & gender
3. Mobile phone No.
4. ID/password
5. Email address
The above items shall be filled in with the member's own information, and updated when changes occur. Penalties may be imposed if false information is entered or not renewed.
※ Children under the age of 13 shall not use the service.
(If a minor under the age of 13 uses the service, he/she may be subject to disadvantages such as ineligibility for insurance coverage in the event of an accident.)
(According to Article 732 of the Commercial Act, life insurance does not apply to those under the age of 15.)
For minors under the age of 14, consent of a legal representative shall be required when signing up for membership and the personal information of the legal representative shall be additionally collected.

Article 6 (Reservation and Rejection of Membership)

① Seoul Bike may withhold membership registration approval in the following cases.

1. If there is a problem with the use of a Seoul Bike due to technical problems

2. When it is deemed necessary for the efficient operation of the Seoul Bike system

② Seoul Bike may reject any request for membership registration that fall under each of the following subparagraphs.

1. In the case of applying for membership by stealing someone else's name;

2. In the case of filling in false information at the time of registration;

3. A person whose membership has been terminated pursuant to these Terms and Conditions.

Article 7 (Change of Member’s Personal Information)

① Members may view or modify their personal information at any time in My Space on the Seoul Bike website or app. However, personal information determined to be necessary by Seoul Bike for service management cannot be modified.

② In the event that the information entered at the time of membership application is changed, the member shall make the modification online or notify Seoul Bike of the change by other means such as email.

③ Seoul Bike shall not be held responsible for any disadvantages caused by not notifying the changes in Paragraph 2 to Seoul Bike.

CHAPTER 3. USE OF SERVICES

Article 8 (Service Provision)

① The contents provided by Seoul Bike are as follows.

1. Bike rental service (limited to within the administrative jurisdiction of Seoul City)

2. Payment services for bike use fee payment

① Seoul Bike may develop and provide additional services to members in addition to the services in each subparagraph of Paragraph 1.

② In principle, the service is provided 24 hours a day, 365 days a year.

③ In case of maintenance, inspection, replacement, and breakdown of information and communication facilities necessary for system operations, communication interruption, or significant reason for operation is impossible to provide the services due to maintenance and repair of the Seoul Bike service facility; or in the event of an abnormal situation such as a national emergency, shutdown of service facilities, system paralysis due to excessive service use, poor weather conditions such as a typhoon, rain or heavy snow; or if it is impossible to provide the service in order to prepare (restore) the above emergency situation, Seoul Bike may temporarily suspend the provision of services. In this case, Seoul Bike must notify the members of the suspension. However, if there is an unavoidable reason that Seoul Bike cannot give advance notice, it may do so after the fact.

④ In addition, the use of the service may be temporarily or locally restricted due to the temporary closure of the Seoul Bike Rental Station for emergency work, failure of the bike racks and terminal, or other similar reasons.

⑤ Seoul Bike may conduct an inspection, if necessary, to provide services, and the inspection time will follow the notice posted on the Seoul Bike website or app.

⑥ For Seoul Bike, mileage shall be awarded when transferring from a to or from to a within 30 minutes and using it as a means of transportation only after a commutation ticket citizen has registered a public transportation transfer card. Regardless of the order of use, 100 points are given at a time, with up to 200 points accumulated per day (twice daily), and up to 15,000 points accumulated per person per year. Accumulated mileage can be used to purchase a commutation ticket or pay additional fees (or unpaid fees, etc.) within 2 years from the date of occurrence (However, transfer mileage shall be provided only for tickets announced by Seoul Bike). When membership is canceled (withdrawn), the mileage shall be forfeited.

Article 9 (Precautions When Using the Service)

① The user shall use the bike by paying the bike use fee through the service provided by Seoul Bike.

② When using a bike through the service, the user shall comply with all relevant laws and the provisions stipulated by local laws and regulations, such as the Road Traffic Act, the Promotion of the Use of Bicycles Act, and related enforcement decrees, enforcement rules, and ordinances on the activation of bike use individually prescribed by each local government, as well as the content stipulated in these Terms and Conditions.

③ When using the service, members who intentionally or negligently violate the provisions stipulated in the Paragraph 2 of these Terms and Conditions and related laws and local laws and regulations shall be subject to the disadvantages stipulated in these Terms and Conditions or the disadvantages stipulated by relevant laws and local laws and regulations, and Seoul Bike shall not be held responsible for the above.

Article 10 (Service Hours)

① The basic rental time for each rental of the Seoul Bike 1-hour ticket shall be 60 minutes, and repeated rentals are possible if it is returned within 60 minutes per rental. In the case of a one-day ticket, users may use it for 24 hours from the start of rental. In principle, if one-time use exceeds the 60 minute rental time, an additional charge designated by Seoul Bike shall be paid.

② The basic rental time for each rental of the Seoul Bike 2-hour ticket shall be 120 minutes, and repeated rentals are possible if returned within 120 minutes per rental. In the case of a one-day ticket, users may use it for 24 hours from the start of rental. In principle, if one-time use exceeds the 120 minute rental time, an additional charge designated by Seoul Bike shall be paid.

③ If it is not returned in under the maximum overtime, it shall be considered lost (stolen) and may be reported as lost (stolen).

Article 11 (Service Use Fee)

① Service use of Seoul Public Bike is charged, and the use fee set by Seoul Public Bike shall be collected.

② Seoul Bike shall notify the members of the use fee, additional fees, and refund information applied to the service through the website and app use policy.

③ In some cases, the standards for calculating the use fee may be changed, and Seoul Bike shall not be held liable for any damages suffered by a member not being aware of it despite the appropriate notice and guidance provided by Seoul Bike.

④ If the basic rental time is exceeded, an additional fee shall be charged through the payment method used to purchase the pass or the payment method designated in advance by the user.

⑤ The user himself/herself shall bear the fines and additional charges imposed due to the user's own violation (violation of the Seoul Bike Service Terms and Conditions of Use) while operating a Seoul Bike.

Article 12 (Suspension and Termination of Membership)

① Seoul Bike may suspend or cancel membership in any of the following cases.

However, in violation of Article 16 (7) 18 of these Terms and Conditions, if a user operates a Seoul Bike while intoxicated with a blood alcohol concentration of 0.03% or higher (Article 44 (4) of the Road Traffic Act), the user's qualification shall be suspended for one year.

1. If the facts corresponding to the reasons for refusal to sign up for membership specified in each subparagraph of Article 6 (2) of these Terms and Conditions are confirmed later;

2. In the case of non-compliance with the user's obligations and responsibilities specified in Article 16 of these Terms and Conditions;

3. In the case it is judged inappropriate to maintain membership by violating these Terms and Conditions and related laws, or by committing an act against social order.

① When a member wants to suspend or terminate (withdraw) his/her membership, he/she shall contact the Seoul Bike website or app or the Seoul Bike Call Center to apply for suspension or cancellation of membership.

② Seoul Bike shall refund the basic fee, excluding the deductible amount designated by it, when membership is suspended, terminated, or withdrawn. In the case of a member who has used remaining tickets, a refund shall be processed according to the refund and extension regulations.

③ A member may file an objection against the suspension of service use pursuant to Paragraph 1 or other restrictions on use related to the use of the service according to the procedure set by Seoul Bike, which shall immediately resume providing the service if it is determined that the member's objection is justified.

④ The member's use of the service shall be suspended until the member's owed amounts to Seoul Bike, such as unpaid expenses and liability for damages incurred in connection with Seoul Bike service, is completely settled. If the member does not continue to pay any amounts owed for a considerable period of time, Seoul Bike may rescind the member's membership. In addition, the criteria for judging service suspension or withdrawal of membership shall be based on Seoul Bike's Terms and Conditions and Use Policy.

⑤ If a member dies, membership shall be lost on the date of death of the member, and all actions performed by a third party to steal the member's membership shall be deemed invalid.

⑥ When a member withdraws his/her membership, the ticket held by the member shall automatically expire.

Article 13 (Refund of Basic Fee and Cancellation of Payment)

① Payment fees and other expenses required for refund processing shall be borne by the member if he/she wants to withdraw and by Seoul Bike in the case of a defect in the Seoul Bike service.

② As for the refund of the basic fee, if the service is not used, the payment for the ticket shall be cancelled (However, small payments by mobile phone for past months among unused tickets shall be refunded), and if the service is being used, the settlement amount in accordance with the Seoul Bike Refund Policy shall be transferred to the member's bank account number. The refund policy shall be published separately on the Seoul Bike website.

Article 14 (Additional Fees)

① When the basic rental time is exceeded, an additional charge of 200 won shall be accumulated and charged to the user every 5 minutes.

② An additional fee shall be charged up to 30,000 won per rental.

③ In the case of additional charges for bike rental/ return services due to the user's own negligence, the user shall be responsible for the full amount.

Article 15 (Obligations of Seoul Bike)

① Seoul Bike shall not disclose or distribute the personal information of a member entered at the time of membership registration to a third party without his/her consent. However, if it falls under Articles 17 and 18 of the Personal Information Protection Act, it may be provided to a third party without his/her consent.

② Seoul Bike shall notify members through the website or notification as to any changes or additions to the service contents.

③ Member's personal information entered at the time of membership registration shall be deleted at the same time as membership withdrawal.

Article 16 (Obligations and Responsibilities of Users)

① The user shall maintain the safety and confidentiality of his/her mobile phone number, rental password, and payment information necessary for using the Seoul Bike service, and bear full responsibility for all damages caused by neglecting management of his/her mobile phone number, rental password, payment information, etc.

② The user shall be solely responsible for the information entered by him/herself in relation to the use of the service and any responsibilities and disadvantages incurred in relation to the information.

③ The user shall check the terms of service before using such services, and bear personal liability for all losses and damages caused by using the service without checking the terms of service.

④ The user shall use the payment method in his/her own name when using the service, and not use another person's payment method arbitrarily. The user shall be held liable for any loss or damage caused by arbitrarily using another person's payment method.

⑤ The user shall cooperate with Seoul Bike for the sake of safely providing services. When Seoul Bike discovers a user's violation of these Terms and Conditions and use policy, and requests the user to explain the violation, the user shall actively respond to Seoul Bike's request.

⑥ Use of the service shall be premised on the user's own use.

⑦ The user shall not engage in any of the following acts when operating a Seoul Bike.

1. An act of registering false information when a member signs up for service or changes member information;

2. An act of stealing other people's information to sign up for or use the service;

3. An act of collecting other members' personal information and account information;

4. An act of authorizing the use of a member's account by others, an act of transferring or transferring the right to use, and an act of joint use;

5. An act of leaving bike in any place other than the Seoul Rental Station, or outside the designated areas;

6. An act of riding a bike with more than one person in tandem, and an act of riding with animals or other objects that cause harm to other users;

7. An act of remodeling, repairing, or transforming a Seoul Bike for personal use, or an act of arbitrarily removing various equipment attached to Seoul Bike or using it for other purposes;

8. An act of operating outside the service area of Seoul Bike (Seoul administrative jurisdiction) or using its bikes in an area where bike riding is prohibited;

9. An act of using Seoul Bike for commercial transactions and as an auxiliary means (freight transportation, etc.) for the purpose of commercial transactions, rather than for transit purposes;

10. An act of copying or providing the information obtained from the service to a third party for purposes other than membership use without the consent of the operator Seoul Bike;

11. An act of infringing on the rights of other users or third parties using Seoul Bike;

12. An act that may impair the proper functioning of the network;

13. An act of using the service or app with incompatible or unauthorized devices;

14. An act of intentionally obstructing the service operation of Seoul Bike;

15. An act of using Seoul Bike in an illegal way without paying the set fee;

16. An act that hinders normal rentals and returns of bikes by using them in a way contrary to the manual and user’s guide posted on the Seoul Bike app (web);

17. In the case of unreasonable violation of the human rights of Seoul Bike workers (abusive language, assault, sexual harassment, obstruction of business, etc.)

18. An act of operating Seoul Bike while intoxicated.

⑧ If the Seoul Bike facility is damaged by the user with intent or negligence during the use of a Seoul Bike, the entire replacement cost may be imposed on the user.

⑨ The cost of the above ⑧ shall be collected through the registered payment method of the user or through the payment method designated by the member.

⑩ The user shall comply with the following obligations and responsibilities when operating a Seoul Bike.

1. When renting a Seoul Bike, the user shall check whether the bike's gears and safety devices are working. If there is a problem in operations, the user shall report any malfunction/ breakdown through the Seoul Bike Call Center and desist from operation of the bike.

2. When a user stops or parks a Seoul Bike after renting it at a location other than the rental station, the user shall use the locking device attached to the bike to prevent theft.

3. Users shall be careful about damage, loss, or theft of the bike that may occur when renting a Seoul Bike.

4. If the user is in an abnormal physical condition (if normal judgment and operation is impaired due to being intoxicated (under the influence), or if blood alcohol concentration according to relevant laws is exceeded), he/she shall not rent a bike.

※ Article 44, Paragraph 1 of the Road Traffic Act: While intoxicated, no one shall drive any motor vehicle, etc. or tram, or ride a bike.

5. When renting a Seoul Bike, users shall wear a safety helmet.

6. Seoul Bike shall not be used for purposes other than transit (i.e. racing, mountain biking, cross-country trips, bike stunts, etc.)

7. When operating a Seoul Bike, the user shall not carry an excessive weight of load to interfere with steering or braking.

8. In the event of poor weather conditions such as rain, fog, or gusts of wind, the user shall not rent a Seoul Bike.

9. The user shall return the Seoul Bike in the same condition as when it was rented (excluding normal wear and tear, tire wear, etc. from its normal operation).

10. The user shall operate the Seoul Bike so as not to obstruct pedestrian pathways/footpaths.

⑪ Seoul Bike may suspend or terminate the use of its services if it determines that the user has violated the provisions of Paragraph 7, and he/she shall bear all responsibility as a result of this.

⑫ The user shall immediately notify the Seoul Bike Call Center if any of the following situations occur while using the service.

1. Damage and loss of a Seoul Bike and terminal during rental

2. Personal injury to members and third parties while operating a Seoul Bike

3. Deleted <2022.7.1.>

⑬ Users shall comply with the relevant laws, the provisions of these Terms and Conditions, the users’ guide and service-related notifications, and Seoul Bike notification.

Article 17 (Notifications to Users)

① Notifications to members can be made through the Seoul Bike app, website, email, SMS, or notification text message provided by the member.

② Notifications to a large number of unspecified users may be posted on the notification on the Seoul Bike website or may be substituted for individual notification through SMS, notification text message, etc.

③ Seoul Bike shall not be held liable for any disadvantages incurred by members as a result of the user not checking the notification even though Seoul Bike has provided normal notification as described above.

Article 18 (Objection and Compensation for Damage)

① Seoul Bike-related organizations and delegated operating organizations shall not be held liable for any problems caused by the user's mistake or negligence. However, in the case of damage caused by the inability to operate a Seoul Bike due to matters attributable to the public office, any compensation shall be limited to the extension of the unused period due to such an inability, and the compensation standard shall follow the refund policy posted on the Seoul Bike website.

② In the event of an abnormal situation including intensification of weather conditions such as a typhoon, rain or heavy snow, or if the service cannot be provided in order to prepare (recover) the above emergency situation, Seoul Bike shall not be held liable for any damages caused to the member.

③ If a user has an accident due to a defect of the bike provided by Seoul Bike while operating it, he/she may be compensated according to the Terms and Conditions of the ‘Public Facilities Liability Compensation Insurance’ subscribed by Seoul Bike.

※ However, since the burden of proving public-use bike defects or management defects is borne by the user himself/herself, in the event of an accident, the user himself/herself shall collect all evidence and submit it when filing for compensation against damages subject to public facilities liability.

※ Evidence refers to photos or videos of the bike taken immediately after the accident, photos that can prove damage to people or property, etc.

Article 19 (Management of Postings)

① If a member's post contains content that violates relevant laws such as the Act on Promotion of Information and Communications Network Utilization and Information Protection and the Copyright Act, the right holder may request the suspension or deletion of the post in accordance with the procedures stipulated by the relevant laws and regulations, and Seoul Bike shall take appropriate measures in accordance with the relevant laws.

② Even if there is no request from the right holder pursuant to the preceding paragraph, Seoul Bike may take temporary measures against the posting in accordance with the relevant laws and regulations if there is a reason for a violation of rights or it violates other policies and related laws.

Article 20 (Copyright of Posts)

① The copyright of posts posted by members within the service belongs to the author of the post.

② Seoul Bike shall obtain the member's consent in advance through telephone, fax, or email, etc., in order to use the member's posts.

Terms of Use for Location-Based Service

CHAPTER 1 GENERAL PROVISIONS

Article 1 Purpose

The purpose of these Terms and Conditions is to stipulate the rights, obligations, and responsibilities of the Seoul Metropolitan Government and members (this refers to a person who has agreed to the Seoul Bike Terms of Use & hereinafter referred to as a “member”.) when using the Seoul Bike location-based service (hereinafter referred to as the “Service”) provided by the Seoul Metropolitan Government (hereinafter referred to as the “Seoul Metro Government”).

Article 2 Effect and Change of Terms of Use

① These Terms and Conditions shall take effect when the customer or the provider of personal location information who applied for the service agrees to these Terms and Conditions and registers as a user of the service according to the prescribed procedure set by the Seoul Metropolitan Government.

② When a member clicks the "Agree" button of these Terms and Conditions online, it shall be deemed that they have fully read and understand the contents of these Terms and Conditions, and have agreed to their application.

③ The Seoul Metropolitan Government may amend these Terms and Conditions to the extent that they do not violate relevant laws, such as the Act on the Protection and Use of Location Information, the Content Industry Promotion Act, the Act on the Consumer Protection in Electronic Commerce, and the Act on the Regulation of Terms and Conditions in the Framework Act On Consumers.

④ When the Seoul Metropolitan Government amends the Terms and Conditions, the existing Terms and Conditions, the amended Terms and Conditions, the date of application of the amended Terms and Conditions, and the reasons for the amendment shall be specified and notified in tandem with the current Terms and Conditions starting from 10 days before the effective date to a considerable period after the effective date. Also, if the amendment is unfavorable to a member, it shall be notified by posting it on the service website or sending the member an electronic form (email, SMS, etc.) of the amendment to the Terms and Conditions starting from 30 days before the effective date to a considerable period after the effective date.

⑤ In the event that the Seoul Metropolitan Government notifies the member in accordance with the preceding paragraph, if the member does not express his/her intention to refuse it from the date of notification until 7 days after the enforcement date of the amended Terms and Conditions, it shall be deemed that the member has approved the terms of use. If the member does not agree to the amended Terms and Conditions, he/she may cancel the terms of use.

Article 3 Application of Related Laws: These Terms and Conditions shall be applied fairly in accordance with the principle of good faith, and matters not specified in these Terms and Conditions shall be governed by relevant laws and commercial practices.

Article 4 Contents of Services: The services provided by the Seoul Metropolitan Government are as follows.

Article 5 Service Use Fee

① Services provided by the Seoul Metropolitan Government shall be basically free. However, in the case of a separate paid service, the user shall pay the fee specified for the service of use.

② The Seoul Metropolitan Government may claim a use fee for any paid services by the method specified by the electronic payment company contracted with the Public office or by adding it to the bill invoice set by the Public office.

③ Cancellations and refunds of payments made through the use of paid services shall be subject to relevant laws such as the payment Terms and Conditions of the Seoul Metropolitan Government.

④ Requests for refunds due to personal information theft and payment fraud by the Seoul Metropolitan Government or requests for personal information from the payer may be rejected, except when it is stipulated by law.

⑤ Data communication charges incurred when using the wireless service shall be separate and follow the policies of each mobile operator that the member subscribes to.

⑥ Fees incurred when registering posts through MMS, etc. shall follow the policy of the mobile operator.

Article 6 Collection and Purpose of Personal Location Information

① The Seoul Metropolitan Government shall collect personal location information in the following cases for theft prevention and operation management of Seoul Bike.

1. Collecting the information of rental/ return notifications and rental/ return dates and times;

2. Collecting the bike location coordinates from the time of rental to the time of return through the terminal attached to the bike (collection of location coordinates at the time of return).

② The Seoul Metropolitan Government shall only check the location information of its public-use bikes used by members in the event of bike theft, accidents, or investigations, and when it is necessary for statistical preparation, academic research, market research, or operation management, it shall be processed and used in a form that does not identify a specific individual.

Article 7 Collection method of personal location information

① The Seoul Metropolitan Government shall collect and store the coordinates of the bike movement path from the bike terminal equipped with GPS every minute from the time of rental, and the collected information shall be transmitted to the Seoul Bike operation server every 10 minutes through LTE communication.

③ When renting or returning a public-use bike, the bike terminal reads the information on the beacon attached to the bike rack of the rental station to check the name of the rental station and date and times of rental and return, with the terminal transmitting the information to the Seoul Bike operation server. In the event of a beacon failure, the user can rent or return it using the GPS of the user's mobile phone.

Article 8 Use or Provision of Personal Location Information

① When the Seoul Metropolitan Government intends to provide services using personal location information, it shall be specified in the Terms of Use in advance and the consent of the provider of personal location information shall be obtained.

③ The Seoul Metropolitan Government automatically shall record and preserve location information use, provision, and fact-checking data for fee settlement and civil complaint handling with other business operators or customers, and retain the data for 24 months.

④ When the Seoul Metropolitan Government provides personal location information to a third party designated by the member, the recipient, provision date, and purpose of provision shall be immediately notified to the member at the email address registered by him/her each time.

Article 9 (Rights of Subject of Personal Location Information)

① Members may withdraw their consent to the provision of personal location information to third parties and the collection and use of personal location information at any time from the Seoul Metropolitan Government by canceling their membership. In this case, Seoul Metropolitan Government shall destroy all personal information and use only location information for statistical data purpose, etc.

② Members may request the Seoul Metropolitan Government for access to or notification as to the data in each of the following subparagraphs, and if there are errors in the data, they may request for corrections. In this case, the Seoul Metropolitan Government shall not reject the member's request without justifiable reasons.

1. Data confirming the collection, use, and provision of location information about the person;

2. The reason and details of the personal location information provided to a third party in accordance with the Act on the Protection and Use of Location Information or other related laws.

③ Members may request the exercise of the rights under Paragraphs 1 to 3 through the procedures prescribed by the Seoul Metropolitan Government.

Article 10 Rights of Legal Representative

① For members under the age of 14, the Seoul Metropolitan Government must obtain consent from the member and his/her legal representative for a consent to the provision of location-based service using personal location information and provision of personal location information to a third party. In this case, the legal representative shall be entitled to all the rights of the member concerned under Article 9.

② If the Seoul Metropolitan Government intends to use the personal location information of a minor under the age of 14 or data confirming the use/ provision of location information beyond the scope specified or notified in the Terms of Use or provide it to a third party, the consent of the minor under the age of 14 and his/her legal representative shall be obtained. However, the following cases are excluded.

1. When data to confirm the use/ provision of location information is required for the settlement of charges for location information and location-based service provision;

2. When the information is processed and provided in a form that cannot identify a specific individual for statistical preparation, academic research, or market research.

Article 11 Designation of Location Information Manager

① The Seoul Metropolitan Government shall designate a person in a position to assume managerial and practical responsibility as the location information manager, so that location information can be properly managed and protected, and complaints from the provider of personal location information can be duly handled.

② The location information manager shall be the head of the department that provides location-based service, while specific details shall follow the Addenda of these Terms and Conditions.

Article 12 Compensation for Damages

① In the event that the Seoul Metropolitan Government violates the provisions of Articles 15 to 26 of the Act on the Protection and Use of Location Information and causes loss/ damages to members, they may claim compensation for loss/ damages caused by the Seoul Metropolitan Government. In this case, if the Seoul Metropolitan Government cannot prove that it did not act with intent nor negligence, it shall not be exempted from liability.

② If a member violates the provisions of these Terms and Conditions and causes damage to the Seoul Metropolitan Government, it may claim compensation for loss/ damages from the member. In this case, if the member cannot prove that he/she did not act with intent nor negligence, he/she shall not be exempted from liability.

Article 13 Indemnification

① If the Seoul Metropolitan Government cannot provide the service in any of the following cases, the it shall not be held liable for any damages caused to the member.

1. In case of natural disaster or force majeure equivalent thereto;

2. In case of intentional interference with the service of a third party that has entered into a service partnership contract with the Seoul Metropolitan Government to provide the service;

3. If there is a problem in using the service due to reasons attributable to the member;

4. In case of any cause other than subparagraphs 1 through 3 that the Public office did not act with intent nor negligence.

② The Seoul Metropolitan Government shall not guarantee the reliability, accuracy, etc. of the service and the information, data, facts, etc. posted on the service, nor be held liable for any damage to members as a result of this.

Article 14 Application Mutatis Mutandis of Provisions

① These Terms and Conditions shall be stipulated and implemented by the laws of the Republic of Korea.

② Matters not stipulated in these Terms and Conditions shall be governed by relevant laws and commercial practices.

Article 15 Mediation of Disputes and Others

① The Seoul Metropolitan Government may apply for arbitration by the Korea Communications Commission in accordance with the provisions of Article 28 of the Act on the Protection and Use of Location Information if there is no agreement between the parties or if it is impossible to reach an agreement between the parties regarding a dispute related to location information.

② The Seoul Metropolitan Government or the member may apply for mediation by the Personal Information Arbitration Committee in accordance with the provisions of Article 43 of the Personal Information Protection Act if there is no agreement between the parties or if it is impossible to reach an agreement between the parties regarding a dispute related to location information.

③ Any disputes as to the rights of members or their legal representatives and method of exercising them shall be formally settled based on the physical address of the user at the time of filing, and if there is none, the district court having jurisdiction over the place of residence shall have exclusive jurisdiction. However, if the address or residence of the user is not clear at the time of filing, or if the user is a foreign resident, the complaint shall be submitted to the competent court under the Civil Procedure Act.

Addenda

Article 1 Enforcement Date

These amended Terms and Conditions shall be effective from July 1, 2022. However, in accordance with relevant laws, provisions that require the customer's explicit consent shall be applied after the customer's consent.

Article 2 Required Items and Mileage-Related Application Examples: For matters related to Article 5 (3) (Required Information) and Article 8 (7) (Mileage) of the Terms and Conditions, the enforcement date will be notified separately after November 2020.

  • Personal information is used for marketing and promotion purposes, such as providing event or advertising information, participation opportunities, and services according to user characteristics, as well as posting advertisements.

6. Matters Concerning the Rights and Obligations of Information Providers and Legal Representatives and Methods of Exercising Them

  • ① The information provider may exercise the right to view, correct, delete, and suspend the processing of personal information at any time against <Seoul Bike> (‘www.bikeseoul.com’).

  • The exercise of rights pursuant to Paragraph 1 may be conducted in writing or by email, fax, etc. in accordance with Article 41 (1) of the Enforcement Decree of the Personal Information Protection Act against <Seoul Bike> ('www.bikeseoul.com'), and (‘www.bikeseoul.com') shall take action in a timely manner.

  • ③ The exercise of rights pursuant to Paragraph 1 may be done through an agent such as a legal representative of the information provider or a formally delegated agent. 8. Personal Information Destruction Procedures and Methods
